Death due to Illegal Abortion – NHRC Sought  Report

Kendrapara: The National human Rights Commission (NHRC) has a Report from the SP of  Jagatsinghpur, Odisha to submit  the status report/final outcome of Raghunathpur PS case No.11 dated 13.2.2018 and another report from the Secretary, Health & Family Welfare, Government of Odisha is directed to submit report within six weeks regarding action taken against the clinic of Dr. Haramani alias Mamata Moharana in the light of report of the SP, Jaisinghpur where a girl died due to illegal abortion.

Acting on a petition filed by Rights campaigner Radhakanta Tripathy the NHRC has been monitoring the case. Tripathy alleged that the dead body of the victim girl was found in the forest area. It was suspected that she died while she was being operated illegally for abortion. The family members were trying to hide the case. The negligence and failure of the Health officials and district administration in acting over the issue is a serious question of human rights. He has prayed to investigate the case and action against the errant officials and compensation to the family members of the victim.

Pursuant to directions of the Commission, the SP, Jagatsingpur, Odisha, stated that on complaint of Ravinder Malik, In-charge of Raghunathpur PS registered PS case No. 11 dated 13.2.2018 u/s 302/201/34 IPC and investigation was taken up. During course of investigation, it was found that the deceased was studying in Rahama College in +2 in the year 2013. She was staying with her parents. The father of the deceased was informed that menstruation of his daughter stopped. She was taken to a private medical doctor and some medicine was given. When there was no fruitful result, the victim again on 9.2.2018 was taken to Mamata Clinic, Jagatsinghpur for treatment.

The concerned doctor and nurse conducted abortion of the victim. During abortion, the condition of the victim girl became serious and ultimately she died. Thereafter, father of the victim in connivance with the doctor, her staff and auto-rickshaw driver, threw the dead body of the deceased girl packed in a gunny bag in the forest area. During investigation, six accused persons including the father of the victim girl and doctor have been arrested. There is sufficient evidence against them u/s 302/313/314/301/109/34 IPC and 23 PNDT Act, 1994 and they have been forwarded to the Court on 17.2.2018.

In his rejpoinder Tripathy stated that the report admits the death caused by abortion was completely illegal and done by a qualified doctor with qualified nursing staffs in a clinic. Its laughable that at the end the report states “the allegations could not be substantiated”.

The age of the deceased and the person who impregnated her are not mentioned in the report. The wrong doer, who raped the deceased is yet to be arrested.

Tripathy requested the NHRC to investigate the case and sought the age of the deceased and the wrong doer who raped her , action taken by the Police to raid such illegal clinics and arrest the doctors and other staffs ,where illegal abortions are taken place.
