EOW arrests realtor in Rs 3.66 crore fraud case

Bhubaneswar: Economic Offences Wing, Bhubaneswar, arrested the director of M/s DRM Infrastructure Pvt. Ltd. from Bhubaneswar in connection with a fraud case Thursday.

The arrested person has been identified as Dhruba Charan Mohanty. He was arrested in connection with EOW PS case (Case No. 19 dtd.24.09.2018 u/s 467/468/471/420/406/120-B IPC, R/w Sec. 6 of OPID [Odisha Protection of Interests of Depositors (In Financial Establishment)] Act, 2011.

He was produced before the designated court (under OPID Act, 2011), Cuttack and had been remanded to judicial custody as his bail plea was rejected.

According to STF, Bijaya Mishra, a resident of Sailashree Vihar, Bhubaneswar had entered into a development agreement with M/s DRM Infrastructure Pvt. Ltd. in 2009 for construction of a multi storied building over a plot owned by her under Mouza- Kalarahanga, with mutual agreement of 35% and 65% share in favour of complainant and builder respectively.

However, after completion of the building, M/s DRM Infrastructure Pvt. Ltd. represented through its MD and Director, cheated her by not providing any flat/share and sold those flats to other different persons and misappropriated the money.

During the investigation, it came to fore that Dhruba Charan Mohanty and his son Dhruti Ranjan Mohanty are the MD and Director respectively of M/s DRM Infrastructure Pvt. Ltd. In the year 2009, a mutual agreement was executed between the complainant and accused company, M/s DRM Infrastructure Pvt. Ltd represented through its Director. As per the agreement, the company would construct a multi storied building over an area of Ac.0.25 dec. land owned by complainant in Mouza-Kalarahanga and from out of the flats constructed, the complainant would get share of 35% of super built up area and the company would get 65% as its share.

However, Dhruba Charan Mohanty had sold those flats (in the share of complainant) to other different persons without the knowledge of the complainant and some flats are sold in more than one occasion.

By way of such fraudulent transaction they wrongfully gained about Rs. 3.66 crores causing corresponding wrongful loss to the complainant and misappropriated those amounts.

Notably, Dhruti Ranjan Mohanty, the MD of the company, has earlier been arrested.

A detailed investigation in underway, it was learnt.
