Odisha: Youth gets 10-year RI for kidnapping, raping minor

Kendrapara: Additional District and Sessions Judge-cum-Special Judge (POCSO) Pranati Pattanaik Saturday convicted one youth for raping a minor girl and sentenced him to 10 years of Rigorous Imprisonment (RI) along with a fine amount of Rs4,000.

The judge further ordered that the convict would undergo another six months of RI if he failed to pay the fine amount, Special Public Prosecutor Manoj Kumar Sahoo said.

The 26-year-old convict identified as Mustafar Khan of Gopalpur village under Aul police station was sentenced to 10 years RI and a fine of Rs4000 for kidnapping a minor girl from his village July 5, 2017, and raping her several times.

According to the prosecution, the accused used to stalk the minor girl, who was studying in Class-X in the local high school. The victim girl had rejected the love proposal of Khan.

July 5, 2017, while the victim was returning from tuition on her bicycle, the accused forcibly kidnapped the girl and took her to a house in Indupur area and spent the night. Later he took her to Visakhapatnam and stayed with the victim minor girl in a rented house. He also shifted the girl to Hyderabad where he stayed in a rented house and forcibly raped her several times.

When Khan came to know that the victim girl’s mother had lodged an FIR against him at Aul police station, he sent the minor girl to Kendrapara with the help of a friend. The victim’s mother had lodged an FIR July 6, 2017 at Aul police station. The accused was later arrested by the police.

While adjudging the case under Sections 341, 366, 376(2)(i)(n) of IPC, Section 6 of POCSO Act, the judge after verifying the evidences and cross-examining the witness, pronounced the judgment.
